OFFICIAL RULES

NAME OF SPONSOR


Carnegie Science Center (component of Carnegie Institute), a Pennsylvania nonprofit corporation (“Sponsor”), One Allegheny Ave., Pittsburgh, PA 15212.

NAME OF ADMINISTRATOR


Trib Total Media, Inc., a Pennsylvania corporation (“Administrator”), D.L. Clark Building, 503 Martindale St., 3rd fl., Pittsburgh, PA 15212.

TERM


The 2011 Carnegie Science Center Photography Contest (“Contest”) begins Feb. 15, 2011, 12:01:00 a.m. US Eastern Time and ends March 31, 2011, 11:59:00 pm US Eastern Time. Information on how to enter the Contest and to identify the prizes are included in these official rules (“Official Rules”). By submitting an entry, each entrant agrees to the Official Rules and represents and warrants that his or her entry complies with all requirements set out in the Official Rules.

WHO MAY ENTER


All entrants must reside in one of the following Western Pennsylvania counties: Allegheny, Armstrong, Beaver, Butler, Clarion, Crawford, Erie, Fayette, Forest, Greene, Indiana, Jefferson, Lawrence, Mercer Venango, Warren, Washington, or Westmoreland.

Each entrant must be an amateur photographer, and no entrant may be a Professional Photographer. Professional Photographer” shall mean an individual who has been paid for any photography services within the past six months or who has ever engaged in photography as his or her paid occupation, either in a full-time or part-time capacity.

Any individuals (including but not limited to employees, consultants, independent contractors, interns, and volunteers) who have, within the past six months, performed services for Sponsor or Administrator, any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest or supplying the prize(s), and their respective parent, subsidiary, affiliated and successor companies, and Immediate Family and Household Members of such individuals, are not eligible to enter the Contest. “Immediate Family Members” shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. “Household Members” shall mean people who share the same residence at least three months a year.

HOW TO ENTER


  1. To enter, visit http://contest.triblive.com, complete an entry form with the required information, including the entrant’s name, address, telephone number, email address, and photo caption, and submit the entry form along with the entrant’s photograph(s) in accordance with the instructions that follow.
  2. Each entry will be submitted in one of three categories (each a “Category”) depending on the entrant’s age on March 31, 2011:
    • 18 years old and up
    • 13 – 17 years old
    • 12 years old and younger
  3. Each entrant may submit one or two photographs.
  4. Each photograph should convey or show a scientific phenomenon, principle, fact, property, experience, or event – for instance, a candle for combustion, an apple falling out of tree for gravity. The photo can be captured in a “controlled” studio setting or as found “live” in natural world.
  5. All photographs must be in good taste and have artistic value. Sponsor and Administrator reserve the right to exclude any image that either of them or their representatives deem obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate, in their sole and unfettered discretion.
  6. Each Contest entry must comply with the following requirements and all other rules and requirements in these Official Rules (the “Photograph Requirements”):
    • Photographs must be in digital format. Only online entries will be eligible. No print or film submissions will be accepted for entry into this Contest.
    • Photographs need not be taken with a digital camera; converted scans of negatives, transparencies, or photographic prints are acceptable.
    • All digital files must be in JPG format and must be no more than 1,000 pixels on the longer dimension. Reduction in original file size is permitted to meet this requirement.
    • Photographs may be “enhanced” only to the extent of cropping, dodging/burning (lightening/darkening), contrast, color balance, image sharpening, and exposure adjustments.
    • Photographs taken with fish-eye lenses are permitted.
    • No retouching, digital manipulation, multiple exposures, or artificial or computer generation techniques are permitted. Judges will disqualify any photograph that they determine has been altered in any of these ways.
    • Any changes to the original photograph not itemized here are unacceptable and will render the photograph ineligible for a prize.
    • Photographs that include sculptures, statues, paintings, and other works of art will be accepted as long as they do not constitute copyright infringement or fraud; entrants must be prepared to provide a release form as described below in “Release.” Any photograph of the work of others must be of an object in its environment and not a full-frame close-up of another person's art.
    • No photographs containing recognizable faces are permitted.
    • By submitting a photograph, the entrant represents and warrants that the entrant is the owner of the copyright.
    • By submitting a photograph, the entrant grants to Sponsor and Administrator nonexclusive licenses to publish the photograph on their respective websites, grants to Sponsor a nonexclusive license do display the photograph in any of Sponsor’s galleries, and grants to Sponsor and Administrator nonexclusive licenses to publish the photograph in either electronic or paper media.
    • The photograph, in its entirety, must be a single work of original material taken by the Contest entrant. By entering the Contest, entrant represents, acknowledges, and warrants that the submitted photograph is an original work created solely by the entrant, that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity, or other intellectual property rights of any person or entity, and that no other person has any right, title, claim, or interest in the photograph.
    • The photograph must not, in the sole and unfettered discretion of Sponsor or Administrator, contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content.

The entries in each Category will judged separately, in accordance with the Judging Criteria described below. All entries must be submitted and received by March 31, 2011 11:59:00 pm. Proof of submission is not proof of receipt.

Entries must be made by the Authorized Account Holder of the email address submitted at the time of entry. “Authorized Account Holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, internet domain owner, or other person or organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor and Administrator reserve the right to examine the original photograph/source material in order to confirm compliance with these rules.

Sponsor reserves all rights in determining eligibility and appropriateness of images. Any entrant not following/abiding by rules is subject to disqualification. All decisions are final.

JUDGING


Photographs that are submitted and deemed to meet the requirements as set forth in these rules will be judged by a panel with representatives chosen by Sponsor and will also be posted online for public (“People’s Choice”) voting.

The panel of judges will use the following criteria:

  • STEM (Science, Technology, Engineering, Math) Concept: Image should capture the science theme as noted by the entrant.
  • Impact: The sense one gets upon viewing an image for the first time.
  • Creativity: The original, fresh, and an external expression of one’s imagination.
  • Composition: Overall design of the image.
  • Technical Quality: Degree to which image demonstrates quality photographic controls.

Winners will be announced on Monday May 2, 2011, and will be notified by email.

Decisions of the judges are final and binding.

People’s Choice Voting: Photographs of all eligible submissions will be posted online from noon on Friday, April 1, through Friday, April 15, 11:59 pm. Visitors to the website will be able to vote for their favorites.

CONTEST PRIZES


Winners selected by the judges as well as People’s Choice winners in each Category will be announced on the website and/or in the Tribune Review newspaper. The prizes are:
  • 18 years old and up: $500
  • 13 – 17 years old: $250
  • 12 years old and younger: $100

The winning photographs will be on display at Carnegie Music Hall during the Carnegie Science Center Awards gala on May 6, 2011, and also at the Carnegie Science Center on electronic monitors.

The People’s Choice winner in each Category will receive a family membership to Carnegie Museums of Pittsburgh.

Potential winners shall be required to sign and return, within ten (10) days following an attempted notification, an Affidavit, Declaration or Certificate of Eligibility, Liability Release, and where legally permissible, a Publicity Release and Warranty of Ownership and License, in a form satisfactory to Sponsor and Administrator, in their sole and unfettered discretion. At a minimum, the entrant will be required to represent and warrant that he/she is the owner of the photograph (and all the intellectual property rights in the photograph submitted), to grant the licenses and rights set forth in these Official Rules, and to grant to Sponsor and its licensees the irrevocable, perpetual, worldwide non-exclusive license to reproduce, distribute, display, and create derivative works of the entry (along with a name credit) in connection with the Contest and promotion of the Contest without additional compensation. Failure to execute and deliver any required documents to Sponsor by the specified deadline may result in disqualification from the Contest and selection of an alternate potential winner.

No prize transfer, assignment, or substitution by winners permitted. If a prize (or part of a prize) is unavailable, the Sponsor, in its discretion, reserves the right to substitute the original prize (or that part of the prize) with an alternative prize of equal monetary value and/or specification, unless to do so would be prohibited by law. NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE, WHETHER BY REGULAR MAIL OR BY EMAIL, MAY RESULT IN DISQUALIFICATION AND SELECTION OF AN ALTERNATE POTENTIAL WINNER.

RELEASES


If the photograph contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons appear in the photograph, the entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the publication, exhibition and use of the photograph in the manner set forth in these Official Rules without additional compensation.

Upon Sponsor's request, each entrant must be prepared to provide (within seven (7) calendar days of Sponsor's request) a signed release from all persons who appear in the photograph submitted, and/or from the owner of any material that appears in the photograph entry, authorizing Sponsor to reproduce, distribute, display, and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by Sponsor. Failure to provide such releases upon request may result in disqualification at any time during the Contest and selection of an alternate winner.

Upon Sponsor's request, each entrant must be prepared to provide (within seven (7) calendar days of Sponsor's request) a signed written license from the copyright owner of any sculpture, artwork, or other copyrighted material that appears in the photograph entry, authorizing Sponsor to reproduce, distribute, display, and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

Upon Sponsor's request, each entrant must be prepared to provide (within seven (7) calendar days of Sponsor's request) a signed written license from the owner of any private property included in the photograph entry, authorizing Sponsor to reproduce, distribute, display, and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

For the purposes of these Official Rules, the entrant will be deemed to be in receipt of Sponsor's request or notification, (a) in the event that Sponsor sends the request by postal mail, five business days after the request was sent by Sponsor, or (b) in the event that Sponsor sends the request by email, on the day that the email was sent by Sponsor.

LICENSE


By entering the Contest, all entrants grant an irrevocable, perpetual, worldwide non-exclusive license to Sponsor, to reproduce, distribute, display and create derivative works of the entries (along with a name credit) in connection with the Contest and promotion of the Contest, in any media now or hereafter known, including, but not limited to: display at a potential exhibition of winners; publication in the Tribune Review in print or online highlighting entries or winners of the Contest. Entrants consent to the Sponsor doing or omitting to do any act that would otherwise infringe the entrant’s “moral rights” in their entries. Display or publication of any entry on the websites of Sponsor or Administrator does not indicate the entrant will be selected as a winner. Neither Sponsors nor Administrator will be required to pay any additional consideration or seek any additional approval in connection with such use. Additionally, by entering, each entrant grants to Sponsor and Administrator the unrestricted right to use all statements made in connection with the Contest, and pictures or likenesses of Contest entrants, or choose not to do so, at their sole discretion. Neither Sponsor nor Administrator will be required to pay any additional consideration or seek any additional approval in connection with such use.

LIMITATION OF LIABILITY


By entering this Contest, all entrants agree to release, discharge, and hold harmless Sponsor and Administrator, their partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.

Sponsor and Administrator assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Contest entries or entry forms; or alteration of entries or entry forms. Sponsor is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to entrants' or any other persons' computers related to or resulting from participation, uploading or downloading of any materials related to in this Contest.

CONDITIONS


THIS CONTEST IS VOID WHERE PROHIBITED. Entrants agree that this Contest shall be subject to and governed by the laws of Pennsylvania and the forum for any dispute shall be in Pennsylvania, United States of America. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or on connection with this Contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply. Entries shall be void if the Sponsor determines the photograph to not be an original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.

By entering, entrants also agree (a) to be bound by these Official Rules; (b) that all decisions of the Judges, Sponsor, and Administrator are final and binding with respect to all matters relating to the Contest; and (c) if the entrant wins that Sponsor may use the winning photographs and each winner's name, photograph, likeness, and/or voice in any publicity or advertising relating to the Contest or future promotions without compensation or approval (except where prohibited by law). All federal, state/provincial/territorial, and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on prizes are the sole responsibility of the prize winners. In the event that the selected winner(s) of any prize is/are ineligible, cannot be traced or does/do not respond within ten (10) days to a winner notification as required by the “Contest Prizes” Rules above, or refuses the prize, the prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the prize to another entrant.

The Sponsor reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant's identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Official Rules or who tampers with the entry process. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights.

RIGHT TO CANCEL OR SUSPEND CONTEST


If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service, attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor or Administrator that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Sponsor elects to cancel or terminate the Contest, Sponsor will not retain any rights in the submitted photographs.

WINNERS LIST


Winners' names will be available online at http://contest.triblive.com after April 30, 2011.

DATA PRIVACY


Entrants agree that personal data, especially name and address, may be processed, shared, and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The data may also be used by the Sponsor in order to verify the entrant's identity, postal address, and telephone number or to otherwise verify the participant's eligibility to participate in the Contest, and for future Sponsor promotions.

No purchase necessary. One valid entry per contestant.

You must be 13 years of age or older at time of entry to be eligible for this contest. This contest is void where prohibited by law.

Winners will be notified by email. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If Pittsburgh Tribune-Review cannot find an eligible winner for the prize, that prize will not be awarded.

Odds of winning depend on the number of eligible entries received.

Automated voting of any kind is not allowed. Detection of said automated voting will lead to votes being voided.

Only one registered account per voter. If multiple accounts are detected for a single voter, they will be disabled and votes disqualified.

Pittsburgh Tribune-Review reserves the right to substitute any prize with another prize of equal or greater value.

Pittsburgh Tribune-Review reserves the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.

Employees of Pittsburgh Tribune-Review, its respective parent, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.

Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.

Entrants further grant to Pittsburgh Tribune-Review the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.

Pittsburgh Tribune-Review reserves the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.

The Contest and all of the related pages, contents and code are copyright, UPICKEM, Inc., and/or Pittsburgh Tribune-Review. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.

Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.

UPICKEM and Pittsburgh Tribune-Review are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.

All results posted are unofficial until winners respond to e-mail notification.

Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Sponsor reserves the right to withhold prizes until completed form W-9 is received.

This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.

Pittsburgh Tribune-Review reserves the right to change the rules at any time.

This contest is officially sponsored by Pittsburgh Tribune-Review.
